These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Lumina Bespoke ("Company," "we," "us," or "our") governing access to and use of our website, applications, and AI-assisted jewelry visualization services (collectively, the "Service"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Scope of Service
Lumina Bespoke provides digital tools that generate illustrative renderings, multi-angle views, virtual try-on previews, and related creative outputs based on text prompts and/or reference images you supply. The Service is offered for creative exploration, concept development, and marketing inspiration only. We do not manufacture, appraise, certify, or sell physical jewelry. Any output is a computational approximation and must not be relied upon as a manufacturing blueprint, gemological certificate, or investment advice.
2. Eligibility and Account Responsibility
You must be at least eighteen (18) years of age and capable of forming a binding contract in your jurisdiction to use the Service. You are responsible for maintaining the confidentiality of any credentials associated with your use of the Service and for all activity conducted under your account or device session.
3. Credits, Subscriptions, and Billing
Certain features require virtual credits or paid subscription plans. Prices, credit allotments, and plan benefits are displayed at checkout or within the Service interface. All fees are stated in United States dollars unless otherwise noted. By purchasing credits or a subscription, you authorize us and our payment processors to charge your selected payment method for the disclosed amount. Taxes may apply where required by law.
Credits represent a limited, non-transferable license to consume computational generation capacity. Credits have no cash value, are not legal tender, and may not be resold, exchanged, or redeemed for cash except where mandatory law requires otherwise. Unused credits may expire as stated at purchase or upon account closure.
4. Intellectual Property and AI Outputs
Your inputs. You retain ownership of prompts, reference photographs, and other materials you upload, subject to the license you grant us below.
License to operate the Service. You grant Lumina Bespoke a worldwide, non-exclusive, royalty-free license to host, reproduce, process, and transmit your inputs solely to provide, secure, and improve the Service, including routing requests to third-party inference providers where applicable.
Generated outputs. Subject to your compliance with these Terms and applicable law, we assign to you our rights, if any, in outputs generated specifically for you from your inputs, to the extent permitted by our agreements with underlying model providers. You acknowledge that AI outputs may not be unique; similar or identical results may be produced for other users with comparable prompts. We make no warranty of exclusivity, originality, or freedom from third-party intellectual property claims. You are solely responsible for clearance, attribution, and commercial use of any output.
Our brand and platform. All trademarks, logos, interface designs, and proprietary software comprising the Service remain our property or that of our licensors. No rights are granted except as expressly stated herein.
5. Acceptable Use
You agree not to:
- Use the Service for unlawful, fraudulent, or harassing purposes;
- Upload content that infringes intellectual property, privacy, or publicity rights of any person;
- Attempt to reverse engineer, scrape, or overload our systems or third-party model endpoints;
- Circumvent usage limits, credit metering, or access controls;
- Generate content depicting minors, non-consensual imagery, or material prohibited by our safety policies.
6. Chargebacks and Payment Disputes
You agree to contact us at billing@lumina-atelier.com before initiating a chargeback or payment dispute with your card issuer. Initiating a chargeback without first attempting good-faith resolution, or filing a fraudulent or abusive dispute relating to digital credits or subscription services that were delivered in accordance with these Terms, constitutes a material breach. We reserve the right to suspend or terminate access, dispute the chargeback with supporting delivery logs, and pursue recovery of fees, chargeback penalties, and reasonable legal costs where permitted by law.
Because the Service delivers immediate access to digital capacity and generated assets, you acknowledge that claims of "non-receipt" are generally unavailable once credits are debited or generations are successfully returned to your session, except as expressly provided in our Refund Policy.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUTS WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR PRODUCTION, RETAIL, OR REGULATORY COMPLIANCE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMINA BESPOKE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
9. Indemnification
You agree to indemnify and hold harmless Lumina Bespoke from claims, damages, and expenses (including reasonable attorneys' fees) arising from your inputs, your use or publication of outputs, or your violation of these Terms.
10. Modifications and Termination
We may modify these Terms or the Service at any time by posting updated Terms with a revised date. Continued use after changes constitutes acceptance. We may suspend or terminate access for breach, risk, or business reasons, without liability for unused credits except as required by our Refund Policy or applicable law.
11. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory consumer protections in your country of residence apply. Disputes shall be resolved in the state or federal courts located in Delaware, unless otherwise required by law.
